These Terms & Conditions ("Terms") apply to your use of misfitmixers.com, our online store and the Murder on the Rocks companion app (together, the "Services"), which are operated by Misfit Mixers, LLC ("Misfit Mixers", "we", "us" or "our"). By using the Services or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
1. Eligibility and responsible play
You must be at least 18 years old, or the age of majority where you live, to place an order. Our games include cocktail recipes. Any version played with alcohol is for adults 21 and over only, and every recipe has a mocktail alternative. Please drink responsibly, never drink and drive, and follow the laws where you play. We are not responsible for how drinks are prepared or consumed during play.
2. Accounts
You can check out as a guest or create an account. You are responsible for keeping your login details private and for activity under your account. Tell us right away at support@misfitmixers.com if you think your account has been used without permission.
3. Products and pricing
- We try to describe and show our games, expansions, bundles and accessories accurately. Colors and components may vary slightly from photos.
- Prices are shown in US dollars and do not include shipping or taxes unless stated. We may change prices, offers and product availability at any time, but changes will not affect orders we have already confirmed.
- If a product is listed at a clearly wrong price because of an error, we may cancel the order and refund you in full.
- Pre-order and limited items ship when they become available. Estimated dates are not guaranteed.
4. Orders and payment
Your order is an offer to buy. We accept it when we send you an order confirmation. We may refuse or cancel an order, for example if a product is unavailable, payment fails, we suspect fraud, or the order breaks these Terms. If we cancel after you have paid, we will refund you in full. Payment is taken at checkout through our secure payment providers.
5. Promotions and free gifts
Free shipping, free gift and discount offers apply only while they are active and only on the terms shown on the site and at checkout, such as minimum spend, eligible products and limits per order. Gifts have no cash value, and a gift may be removed if the order is later changed or refunded so that it no longer qualifies. Offers cannot be combined unless stated, and we may end or change an offer at any time.
6. Shipping and delivery
We ship to the destinations available at checkout. Delivery times are estimates. Risk of loss passes to you when the carrier delivers your order. If your parcel is lost or arrives damaged, contact us within 14 days of the expected delivery date and we will help.
7. Returns and refunds
Returns, exchanges and refunds are covered by our Refund Policy, which forms part of these Terms.
8. Companion app and site content
The companion app is provided free with our games, as is and as available. We may update, change or retire it at any time, and we do not guarantee that it will always be available or error-free. All game rules, artwork, text, characters, logos and app content belong to Misfit Mixers or our licensors and are protected by copyright and trademark law. You may print or download rulebooks and materials for personal, non-commercial play only. Murder on the Rocks and Misfit Mixers are our trademarks.
9. Reviews and submissions
If you post a review or send us ideas, you confirm the content is yours, is honest and is not unlawful or offensive. You give us a free, worldwide, non-exclusive license to use, display and share it in connection with our products. We may remove any content at our discretion.
10. Acceptable use
You agree not to misuse the Services. This includes attempting to break or overload them, scraping them, using them for unlawful purposes, reselling our products as an unauthorized seller, or infringing anyone's rights.
11. Third-party links and services
The Services may link to or rely on third-party sites and services, such as payment providers, carriers, Kickstarter and social media. We are not responsible for their content or practices.
12. Disclaimer and limitation of liability
Except as stated in these Terms and as required by law, the Services and products are provided without any other warranties, express or implied. To the fullest extent permitted by law, Misfit Mixers will not be liable for any indirect, incidental, special or consequential damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
13. Indemnity
You agree to compensate us for claims, losses and costs (including reasonable legal fees) that result from your breach of these Terms or misuse of the Services.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Pennsylvania, unless the law where you live gives you the right to bring a claim in your local courts.
15. Changes to these Terms
We may update these Terms from time to time. The version posted here when you place an order applies to that order.
